Employee separations are common as the school year ends whether an employee voluntarily chooses to resign, or a school decides to non-renew staff or terminate staff for cause because of poor performance or violation of school policies. With mental health issues and violence impacting our schools, CharterSAFE recognized the urgency to provide our members with resources that can help mitigate these exposures. Because students are more likely to report warning signs of potentially threatening behavior if an anonymous reporting system is available to them, CharterSAFE has continued its partnership with STOPit Solutions to offer FREE resources to members aimed at helping individuals displaying violent, unsafe, or unhealthy behaviors before they escalate into a crisis while also addressing mental health and well-being through upstream education and best practices. With an increase in member requests for assistance in managing employee performance issues concurrent with their request for workplace accommodations, we want to help charter school leaders and HR staff understand the inherent challenges in navigating this “intersection” including how to avoid possible employee claims against your school. To facilitate this learning, we developed a webinar to review the employee discipline process, provide an overview of accommodations and exam the components of the reasonable accommodation/interactive dialogue process. Attendees will take these learning components and apply their knowledge to 3 real-time case studies. We will end the webinar with a review of the CharterSAFE accommodation forms.

What will you learn? Attendees will learn about the following types of separations which end an individual’s employment at a charter school: resignations, non-renewals (including the EDD/School Employees Fund unemployment insurance process), and involuntary terminations such as “for cause” and layoffs. We will also discuss the impact of “at-will” employment in relation to involuntary terminations. Attendees will learn about the steps to take before, during and after any separation. We will also discuss best practice recommendations to manage a layoff and the pros/cons of offering a severance/separation agreement to a departing employee.

COVID-19 Cal/OSHA Emergency Temporary Standard (Members Only)

On November 30, 2020 the Cal/OSHA Emergency Temporary Standards (ETS) went into effect. Employers will be required to have a Written COVID-19 Prevention Program (WCPP). We will discuss the required elements within the program, the similarities and differences between the ETS and AB685. Attendees will understand their requirements under this regulation and be equipped to develop a compliant WCPP.

Executive Order N-62-20 Workers Compensation and COVID-19 (Open to All)

On May 6, 2020, Governor Newsom announced Executive Order N-62-20. This executive order creates a rebuttable presumption which provides Workers Compensation benefits to any employee who contracted COVID-19 within 14 days of working for their employer at their job site or at the direction of the employer.
