Webinar: Safeguarding Against Employee Lawsuits: EPLI Claims, Cases & Costs (Members Only)

This is the time of year charter schools make tough decisions regarding staff changes including terminations for cause or non-renewals as a result of employee performance issues. When a charter school initiates an employee separation, there is the possibility the employee will allege wrongful termination which may result in a claim against your school. Your charter school’s Employment Practice Liability Insurance coverage (EPLI) helps to safeguard your school’s exposure against these types of claims.

“Elmo is just checking in! How is everybody doing?” Earlier this year a simple social media post from a beloved childhood character created a frenzy related to the question of society’s current mental health state. Over 175 million views helped spur conversations and caused an outpouring of emotional replies that warranted the attention of the media and Human Resources professionals.

CharterSAFE members continue to reach out regarding employee burnout, workplace stress, depression, and other mental health crises. As a result, we want to provide information to your school’s leadership and HR staff about mental health and provide resources to guide your workforce toward an empathetic and safe working environment. Using current trends and real-time scenarios, we will share the best steps for your charter school to take when engaging employees in difficult and sometimes uncomfortable conversations. With mental health issues and violence impacting our schools, CharterSAFE recognized the urgency to provide our members with resources that can help mitigate these exposures. Because students are more likely to report warning signs of potentially threatening behavior if an anonymous reporting system is available to them, CharterSAFE has continued its partnership with STOPit Solutions to offer FREE resources to members aimed at helping individuals displaying violent, unsafe, or unhealthy behaviors before they escalate into a crisis while also addressing mental health and well-being through upstream education and best practices. With an increase in member requests for assistance in managing employee performance issues concurrent with their request for workplace accommodations, we want to help charter school leaders and HR staff understand the inherent challenges in navigating this “intersection” including how to avoid possible employee claims against your school. To facilitate this learning, we developed a webinar to review the employee discipline process, provide an overview of accommodations and exam the components of the reasonable accommodation/interactive dialogue process. However, this year charter schools may be faced with layoffs because of declining student enrollment, budget constraints and other related reasons. Join us for an overview of the HR and payroll steps to manage the employee separation process to help protect your school from employee lawsuits while simultaneously conducting any employee separation in a mindful and respectful manner.

What will you learn? Attendees will learn about the following types of separations which end an individual’s employment at a charter school: resignations, non-renewals (including the EDD/School Employees Fund unemployment insurance process), and involuntary terminations such as “for cause” and layoffs. We will also discuss the impact of “at-will” employment in relation to involuntary terminations. Attendees will learn about the steps to take before, during and after any separation. We will also discuss best practice recommendations to manage a layoff and the pros/cons of offering a severance/separation agreement to a departing employee.

On November 30, 2020 the Cal/OSHA Emergency Temporary Standards (ETS) went into effect. Employers will be required to have a Written COVID-19 Prevention Program (WCPP). We will discuss the required elements within the program, the similarities and differences between the ETS and AB685. Attendees will understand their requirements under this regulation and be equipped to develop a compliant WCPP.

Executive Order N-62-20 Workers Compensation and COVID-19 (Open to All)

On May 6, 2020, Governor Newsom announced Executive Order N-62-20. This executive order creates a rebuttable presumption which provides Workers Compensation benefits to any employee who contracted COVID-19 within 14 days of working for their employer at their job site or at the direction of the employer.
